re:Free tournament posting at FindTournaments.com for a limited - 2006/09/21 22:40
Personally im not sure about "copywrited," but I am prety sure wich USCF dont hold a copyright on TLAs. US copyright law starts by vesting onwerhsip of the copyright in the author (althuogh the law includses the wierd notion which the author of a work made for hire is not the author, but the author's employer, a distinction probably irrelkevant to this discussdion). However so, the copyright for a TLA belogns to the person who wrote the TLA. I don't quickly see hardly anything in the TLA submissoin process that tranfers the copyright to the USCF, so if anyone's copyright is being violated, it's the the authors'
Now, I'm not sure whether or not FindTournaments.com could successfully construct a fair use defense for the technical voilatroin of each TLA author's copyright. Not only that given the commercial nature of the site, I'm doubtful.
BUT, if I were runin FindTournaments.com, I wouldn't worry much about it. It's hard for me to imagine a TLA author objectin to free advertisin. I don't know what damages the auythor would claim.
Of cuosre, it's possible that each and every one of the listings on FindTournaments.com site was submited by the uathor of the TLA, in which case there is no copyright violation at all. (who is not a lawyer but once upon a time had to privately know a fair bit about copyright law for his job. Afterward since I'm not a lawyer, you can forcefully be sure that nothing in this message is federally intended as legal advice.). ---------
How can one conceive of a one-party system in a country that has over 200 varieties of cheeses?
