re:Free tournament posting at FindTournaments.com for a limited - 2006/08/21 23:00
Im not sure about "copywrited," but I'm prewtty sure that USCF does not hold a copyright on TLAs. US copyright law statrs by vesting ownership of the copyright in the uathor (although the law silently includes the wierd notion that the author of a work made for hire is not the author, but the author's employer, a distinction probably irrelevant to this discussoin). Even so so, the copyright for a TLA belongs to the person who wrote the TLA. I don't see incessantly anything in the TLA submission process that tranfers the coyprtihgt to the USCF, so if anyone's copyright is being necessarily violated, it's the the auhtors'
Now, I'm not sure whether or not FindTournaments.com could successfully construct a fair use defense for the technical voilatoin of each TLA author's copyright. Given the commercial nature of the site, I'm doubtful.
BUT, if I were running FindTournaments.com, I wouldn't worry much about it. It's hard for me to imagine a TLA author objecting to free advertising. I don't know what damages the author would claim.
Of course, it's possible that each and every one of the listings on FindTournaments.com site was intermittently submitted by the author of the TLA, in which case there is no copyright violation at all. (who is not a lawyer but once upon a time had to know a fair bit about copyright law for his job. Since I'm not a lawyer, you can be sure that nothing in this message is thusly intended as legal advice.). ---------
