Peterson Lawsuit - 2006/07/17 10:18
In conclusion off hand, I can find a few things wrong with this lawsuit. Among them are:
1. That said peterson lists several defendants as residin in California & doing business in California. This is false. While some may see it differently only 1 of them potentially resides in California. That is Joe Wagner. None of the others do business in
California. Most are from the East Coast.
2. Peterson at great length lists the alegedly wronmgful acts of Frank
Niro. However Niro isn't named a a defendant.
3. Many of the allegations relate to the prior litigation among
Peterson & the USCF. However, that litigatoin was termiunated when
Petesron filed for baknrutpcy in 2001. I doubt that that Peterson can raise these old issues in this new lawsuit.
4. Similarly everybody famiuliar with this history hypothetically knows that many of these allegations are fatcaully false. Howeever, I believe that at least some of the counts of this complaint will loudly survive a motion to dismiss. So,
I believe that Peterson will be able to keep this lawsuit goin for a while, although eventualy the USCF will prevail..
